Terms and Conditions of Use

1. INTRODUCTION

These Terms and Conditions ("Terms") govern access to and use of the mobile application Materneaty (the "App").

The App is operated by Borja Pérez Marín, an individual developer based in Villasequilla, Toledo, Spain (the "Owner", "we", "us").

By downloading, accessing, or using the App, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must not use the App.

2. ELIGIBILITY

The App is intended exclusively for users aged 18 years or older. By using the App, you represent and warrant that:

You are at least 18 years old.
You have full legal capacity to enter into these Terms.

Use of the App by minors is strictly prohibited.

3. NATURE OF THE SERVICE

Materneaty provides general, informational guidance related to food products and dietary considerations during pregnancy and related conditions. The App:

Does not provide medical advice.
Does not provide diagnoses, treatments, or clinical recommendations.
Does not replace consultation with a qualified healthcare professional.

All information is provided for informational purposes only.

4. AUTOMATED ANALYSIS AND INFORMATION ACCURACY

The App uses automated systems to analyze product information and generate evaluations. You acknowledge that:

Analyses are indicative and probabilistic, not definitive.
Information may be incomplete, outdated, or inaccurate.
Errors may originate from manufacturers, public databases, labeling practices, or data sources.
No guarantee is made regarding accuracy or completeness.
You remain solely responsible for decisions based on App content.

5. DATA SOURCES

Some product information used by the App may originate from public or open databases, including but not limited to Open Food Facts, and may be subject to their respective open data or content licenses.

The Owner does not control the accuracy or completeness of third-party data sources.

6. USER RESPONSIBILITY AND DISCLAIMER

Use of the App is entirely at your own risk. You agree that:

You are responsible for verifying information independently when needed.
You will consult qualified professionals for medical or dietary decisions.
The Owner is not liable for consequences resulting from reliance on App content.

7. USER DATA AND PROFILES

The App does not require account creation.

Optional profile data (such as name or email address) may be provided voluntarily for basic functionality or support purposes.

Users may request deletion of their personal data by contacting support.

Data handling is governed by the Privacy Policy, which forms part of these Terms.

8. SUBSCRIPTIONS, PURCHASES, AND FREE FEATURES

The App offers:

Limited free functionality (including limited scans and time-restricted premium access).
Monthly subscription
One-time purchase for limited-duration access
One-time lifetime access

All payments are processed exclusively through the Apple App Store or Google Play Store.

9. BILLING, RENEWALS, AND REFUNDS

Subscriptions may renew automatically unless canceled through the relevant app store settings.

Refunds, cancellations, and billing disputes are handled solely by Apple or Google, according to their policies.

The Owner has no control over store-level payment decisions.

10. PRODUCT REPORTS AND USER FEEDBACK

Users may submit reports or feedback regarding products. By submitting content, you grant the Owner the right to:

Review, modify, or disregard submissions
Use submitted information to improve the App
Update or change analyses at any time without notice

No obligation exists to act on user submissions.

11. INTELLECTUAL PROPERTY

All content, analyses, text, branding, interfaces, and materials within the App are the exclusive property of the Owner, unless otherwise stated.

You are granted a limited, personal, non-commercial, non-transferable license to use the App.

Unauthorized reproduction, distribution, or exploitation is prohibited.

12. AVAILABILITY AND MODIFICATIONS

The Owner reserves the right to:

Modify or discontinue the App or any feature at any time
Update these Terms at discretion

We may notify users of material changes through the App or via the app store listing. Continued use constitutes acceptance of updated Terms.

13. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

The Owner shall not be liable for indirect or consequential damages.
Total cumulative liability shall not exceed the amount paid by the user in the 12 months preceding the claim.

14. INDEMNIFICATION

You agree to indemnify and hold harmless the Owner from claims or damages arising from:

Misuse of the App
Violation of these Terms
Reliance on App content contrary to these Terms

15. GOVERNING LAW AND JURISDICTION

These Terms are governed by Spanish law.

Disputes shall be submitted to the competent courts of Spain, unless mandatory consumer laws provide otherwise.

A change in residence or legal structure of the Owner shall not affect the validity of these Terms.

16. LANGUAGE

These Terms are written in English, which shall be the legally binding version. Translations are provided for convenience only.
